Preamble

The General Data Protection Regulation (GDPR) came into effect on May 25, 2018 and completements the legislation on the protection of personal data. Personal data is any information related to an identified natural person or one who can be identified, directly or indirectly, in reference to an identification number or to one or more elements that are specific to them (first name, last name, address, email, phone number, contract number, CB number, …).  A processing of personal data means any operation on this type of data (collection, storage, transmission, deletion, …), whether it is on paper or digital. The person responsible of data processing determines the purposes of each processing and the means to achieve those purposes.  

For Brechbühl School, the protection of your data is a priority. Moreover, for the sake of transparency, this Privacy Policy has the particular purpose of explaining why your personal data is collected and processed by Brechbühl School, in its capacity as data controller; how this data is treated, what rights you have over your data and how can you exercise these rights.

Brechbühl School reserves the right to modify this Privacy Policy at any time. Any changes will take effect immediately.

 

1. Why does Brechbühl School need to collect your data?

Data that Brechbühl School collects is stored in Switzerland according to secure protocols.
The processing of this data has as its purpose:

  • the organization and execution of education services and events offered by Brechbühl School.
  • dissemination of information and offers from Brechbühl School.
  • adapting the education offer to the expectations of the clients of Brechbühl School and improving the quality of the offered services.

The legal basis for this processing relies on your contractual relationship with the Brechbühl School and/or on the legal or regulatory obligations of Brechbühl School or on your consent regarding commercial prospecting processing, which you can withdraw at any time by sending us an email to the following email address: admin@brechbuhl.ch

In general, Brechbühl School does not process your data for purposes incompatible with those for which they were collected, unless you have given prior consent.

 

2. Data controller

The person responsible for the processing of the personal data referred to herein is Sandy BAUDRON, Director of the Brechbühl School, whose registered office is located at Rue Toepffer 3, 1206 Geneva.

 

3. What data does Brechbühl School collect?

Brechbühl School, as a data controller within the meaning of the GDPR, limits the collection of personal data to data that is adequate, relevant and strictly necessary for the performance of its educational activities.
Regarding persons outside Brechbühl School, the data collected is the personal data necessary to commercial prospecting activities on Brechbühl School’s educational offer i.e.:first names, last names, personal contact information, emails and phone numbers of any person who has expressed an interest and consented to receive information content from Brechbühl School.

 

4. Transmission of data

Your personal data is only transmitted to our partners in the aim of ensuring proper execution of the activities of Brechbühl School, in particular:

  • to personnel and teachers to ensure the smooth running of the education and of the contract; 
  • to organizations, judicial officers and ministerial officers as part of their debt collection mission.

 

5. How long is your data kept?

Your data is kept by Brechbühl School during the necessary time to achieve the purposes referred to in point 1, plus the statutory limitation periods.

Data used for commercial prospecting may also be kept until the withdrawal of consent by the concerned person, or by default, 3 years starting the last contact made between the Client/prospect and the School. At the end of this period, Brechbühl School will contact you to determine if you wish receiving commercial solicitations.

6. What are your rights and how to exercise them?

You have the right to request access to your personal data and to rectify inaccurate data.
You can request the deletion of data and the limitation of processing, in accordance with applicable law.
You have the right to the portability of your personal data you provided to the School, under the conditions intended for by the applicable legislation. The only data concerned is the data that you have actively and consciously provided to the Brechbühl School (data that you have entered via the online form), or data generated during the use of a service or scheme in the context of the conclusion or management of your contract, which are processed automatically, on basis of consent or the execution of the contract.
You can object to your data being used by Brechbühl School for a specific purpose.
When the processing of your personal data is based on your consent (sending our electronic commercial offers for example), you have the possibility to withdraw your consent at any time.
Likewise, to withdraw your consent to cookies, you can do so according to the terms mentioned in the Cookies charter.

Any request must specify the purpose of the request (exercise the right of access, opposition, …). In addition, in case of any doubt about the identity of the applicant, the transmission of an identity document may be requested.

 

7. How does Brechbühl School secure the processing of your data?

Brechbühl School implements all technical, physical and organizational measures, to ensure the security and confidentiality of your data during collection, processing and transfer of your data.
The infrastructure of Brechbühl School is protected against malware (virus, spyware, …); the security on your end is your responsibility.
In the case where we would use service providers to process a part of your data, we undertake to verify that they present sufficient guarantees to ensure the protection of the personal data entrusted to them and to have them sign the necessary confidentiality clauses.

 

8. Social Media

Brechbühl School is present on Social Media via a LinkedIn account.
Access to this Social Media implies your prior acceptance of its contractual conditions, including its commitments under the GDPR for the processing carried out by the latter, regardless of our page on said Social Media.
